Terms and Conditions

1. Introduction

Welcome to Supa Sign Pros (the "Company"). These Terms and Conditions ("Terms") govern the transactions and services provided by Supa Sign Pros to its customers (the "Customer"). By engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Definitions

  • Company: Supa Sign Pros.
  • Customer: The individual or entity requesting services from the Company.
  • Services: The new sign construction, maintenance, custom design, and print services offered by the Company.
  • Agreement: The contract formed between the Company and the Customer when the Customer engages the Company's services.

3. Scope of Services

  • New Sign Construction: Includes the design, manufacture, and installation of new signs based on the Customer's specifications.
  • Maintenance Services: Involves scheduled or on-demand maintenance of existing signs, including repairs, cleaning, and updates.
  • Custom Design and Print Services: Covers the creation of custom sign designs and prints according to the Customer's requirements.

4. Quotations and Acceptance

  • Validity: All quotations are valid for thirty (30) days unless otherwise specified.
  • Acceptance: Acceptance of a quotation constitutes agreement to these Terms.
  • Scope Changes: Any changes to the scope of work after acceptance may result in additional charges.
  • Estimate Basis: Estimates are based on the specifications and material costs available at the time of quoting.

5. Payment Terms

  • New Sign Construction: A fifty percent (50%) deposit is required upon acceptance of the quotation, with the remaining balance due upon completion.
  • Maintenance Services: Payment terms will be outlined in the maintenance agreement; invoices are generally due within fifteen (15) days of receipt.
  • Custom Design and Print Services: Payment terms will be specified in the service agreement; invoices are generally due within fifteen (15) days of receipt.
  • Late Payments: Late payments may incur a two percent (2%) monthly late fee.

6. Customer Responsibilities

  • Accurate Information: Provide accurate specifications for new signs and ensure any necessary permits are obtained.
  • Accessibility: Ensure the sign area is accessible for maintenance and repair work.
  • Design Details: Provide comprehensive design requirements and approvals for custom orders.

7. Warranties

  • New Signs: One-year warranty against defects in materials or workmanship.
  • Maintenance Services: Workmanship is warranted for thirty (30) days following the service.
  • Custom Print Services: Thirty (30) days warranty against printing defects.
  • Exclusions: Warranties do not cover damages resulting from misuse, negligence, or unauthorized modifications.

8. Limitation of Liability

  • Indirect Damages: The Company is not liable for any indirect, incidental, or consequential damages.
  • Liability Cap: In all cases, the Company's liability is limited to the amount the Customer has paid for the services in question.

9. Termination

  • Notice: Either party may terminate the Agreement by providing thirty (30) days' written notice.
  • Immediate Termination: The Company may terminate the Agreement immediately in cases of non-payment or material breach of contract.

10. Cancellation Fee

If the Customer cancels any project after work has commenced, a cancellation fee of twenty percent (20%) of the total project cost plus the cost of any completed work may apply.

11. Confidentiality and Ownership

  • Confidentiality: Both parties agree to maintain the confidentiality of any shared business information.
  • Ownership: The Customer obtains ownership rights to the final approved design once full payment has been made. All other design concepts remain the property of Supa Sign Pros.

12. Trademarks and Copyrights

  • Permissions: The Customer is responsible for obtaining any necessary permissions for copyrighted or trademarked materials.
  • Liability: The Company assumes no liability for unauthorized use of copyrighted or trademarked materials provided by the Customer.

13. Force Majeure

The Company is not liable for delays or failures to perform due to circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, or governmental actions.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the state in which the Company operates. Any disputes will be subject to the exclusive jurisdiction of the courts in that state.

15. Entire Agreement

These Terms, together with any written agreements or quotations, constitute the entire agreement between the Company and the Customer, superseding all prior agreements or understandings.

16. Amendments

The Company reserves the right to update or modify these Terms at any time. Continued use of our services after any modifications constitutes acceptance of the revised Terms.

17. Returns Policy

Custom signs and prints are non-refundable unless they are determined to be defective upon inspection by the Company.
